Statement pursuant to Arts. 13 and 14 GDPR 679/2016
Dear Customer,
MARTIN SPECK GMBH recognises the importance of protecting your personal data and undertakes to process these in a manner that is correct, transparent and limited to the extent permitted by EU Regulation 2016/679 (GDPR).

2. Collection and storage of personal data, nature and purpose of processing
Your personal data (data permitting personal identification, such as forename, surname, company name, tax code and VAT no., address, phone/fax, e-mail, bank and payment details) will be processed for the following purposes:
- administrative, tax or internal accounting obligations necessary to comply with the contractual and general obligations incumbent upon the Data Controller on account of laws or rules & regulations, EU regulations, requests from the judicial authorities or in order to ensure compliance with the rights of the Data Controller.
The personal data that we collect will be processed and stored throughout the term of the contract. Upon expiry thereof such data will continue to be saved and stored for the period required by the tax and commercial requirements covering storage and documentation, unless you refuse your consent pursuant to article 6 (1) (a) GDPR.
3. Nature of processing
Your data will be processed using appropriate instruments and procedures, taking security and confidentiality into account; data may be processed by means of electronic devices or in paper form.
4. Mandatory or voluntary communication of data
The communication of personal data for processing purposes is voluntary. Failure to provide some or all data may however result in the incomplete or non-performance of the contract or its continuation.
5. Disclosure to third parties
Your data may if necessary be processed by authorised third parties acting as data processors (article 28 GDPR) or by “autonomous” data supervisors, namely:
- freelancers, companies or firms who assist or advise the Data Controller in respect of administrative, accounting, taxation or legal matters;
- all public authorities as provided by law and, in general, all persons as provided by the applicable accounting and tax legislation as recipients of mandatory communications;
- banking institutions or possibly freelancers – individually, as partners or in company form – for the administration of collection and payment procedures.
The current list of data processors and authorised representatives for processing purposes is kept at the registered office of the Data Controller. No personal data of customers will be disclosed.
6. Transfer of data to third countries or organisations
No transfer of customer data to non-EU third countries or to international organisations is foreseen for the performance of the contract.
7. Rights of data subjects
You have the right:
- pursuant to art. 7 (3) GDPR, you may withdraw your consent to our processing of your data at any time, with the consequence that we may not in future continue processing any data based upon such consent;
- pursuant to art. 15 GDPR, you may request information about which of your personal data is processed by us;
- pursuant to art. 16 GDPR, you may demand the immediate correction of incorrect or complete personal data stored by us;
- pursuant to art. 17 GDPR, you may demand the deletion of your personal data stored by us provided that the processing of such data is not required for the exercise of the right to freedom of expression and information, for compliance with any legal obligation, for reasons of public Interest or for enforcing, exercising or defending any legal claim;
- pursuant to art. 18 GDPR, you may request the restriction of the processing of your personal data if you dispute the correctness of the data, if the processing is unlawful, you however refuse deletion of the data should we no longer need the data but you need such data in order to pursue the business relationship, or you have objected to processing pursuant to art. 21 GDPR;
- pursuant to art. 20 GDPR, you may request that your personal data provided to us be made available in a structured, commonly used and machine-readable format, or request transfer of the data to a different Data Controller;
- pursuant to art. 77 GDPR, you may make complaint to the Supervisory Authority, the “Autorità Garante per la protezione dei dati personali”, Piazza di Montecitorio 121, 00186, Roma (RM).
8. Exercising your rights
- Pursuant to art. 12 GDPR, the exercising of rights by the customer shall be free of charge. In the event of clearly unjustified or excessive demands, including their constant recurrence, the Data Controller may require a reasonable reimbursement of costs to take account of the administrative cost of processing a request, or may reject the request.
- In the event that your personal data are not processed for a legitimate purpose pursuant to art. 6 (1) (f) GDPR, you have the right under art. 21 GDPR to object to the processing of your data and to set out your reasons for this.
